1. Introduction and Acceptance of Terms

Welcome to Everlore! These Terms of Use (the “Terms”) govern your access to and use of the Everlore platform (the “Service”), operated as an application for reading fiction and interactive fiction, where certain works are generated or assisted by artificial intelligence.

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms in full, alongside our Privacy Policy. Please read these Terms carefully. If you do not accept these Terms, you must immediately cease using the Service.

2. Eligibility and Account Registration

Age Requirement: You must be at least 18 years old to create an account and use the Service. By using Everlore, you represent and warrant that you meet this age requirement.

Account Security: Some features require creating an account (email address and password). You agree to provide accurate, complete information and to keep your credentials confidential. You are solely responsible for all activities carried out under your account. You agree to notify us immediately of any unauthorized use or security breach of your account.

3. AI-Generated Content Disclaimer

In a spirit of transparency and compliance with applicable regulations, you are informed that part of the content, text, or illustrations offered on the Service is generated or assisted by artificial intelligence models.

This content consists strictly of works of fiction. AI outputs can be unpredictable, may occasionally reflect systemic biases, and may contain inaccuracies, inconsistencies, or elements unintentionally similar to existing works. It does not constitute factual information, professional advice, or an official position taken by Everlore. You are responsible for your interpretation and use of any outputs.

4. Intellectual Property and Content Rights

Everlore Ownership: The platform, its source code, interface designs, visual identity, original assets, and branding remain the exclusive property of Everlore or its licensors.

User License Grant: To the extent that you create, prompt, or configure unique narrative paths or content within the Service, you retain ownership of your inputs. However, to operate the Service, you grant Everlore a worldwide, non-exclusive, royalty-free, and sublicensable license to host, store, reproduce, and display such content solely to run, maintain, and improve the Service.

Usage of Outputs: Unless explicitly stated otherwise within specific subscription tiers, AI-generated content provided to you through the Service is intended strictly for your personal, non-commercial entertainment use.

5. Acceptable Use and Content Guidelines

You agree to use the Service in compliance with all applicable local, national, and international laws. Specifically, you agree not to create, prompt, share, or exploit content that:

• Depicts, simulates, or exploits minors in any harmful or sexualized context.

• Promotes real-world illegal acts, terrorism, hate speech, or severe self-harm.

• Generates misleading deepfakes or impersonates real individuals without their explicit consent.

• Attempts to circumvent our safety features, access controls, filters, or usage quotas.

Furthermore, bulk data extraction (“scraping”), reverse-engineering the underlying AI models, or disrupting the network infrastructure of the Service is strictly prohibited.

6. Copyright Infringement and Takedown Policy

We respect intellectual property rights and respond promptly to clear notices of alleged copyright infringement. If you believe that any content hosted on the Service violates your copyright, please contact us via our official support channels providing a description of the copyrighted work and the specific location (URL) of the infringing material.

7. Beta Status and Service Modifications

Everlore is currently offered in a beta phase. The Service is provided on an “as is” and “as available” basis. Features may rapidly evolve, be modified, temporarily suspended, or permanently removed at our sole discretion without prior notice. We do not guarantee uninterrupted, error-free operations, or permanent data preservation of your reading history or custom generations during this testing period.

8. Fees and Subscriptions

Everlore offers both free access and premium paid tiers via a monthly recurring subscription. The pricing and specific features of our monthly plans are clearly disclosed on our checkout pages.

Subscriptions automatically renew each month unless canceled before your next billing cycle through your account settings. Payments are processed securely via our third-party provider. Except where required by mandatory European consumer protection laws, payments are non-refundable, and you will retain access to your premium features until the end of your current billing period.

9. User Responsibility

You are entirely responsible for how you interact with the Service and how you use the fictional content generated during your sessions.

If your intentional violation of these Terms, misuse of the platform, or infringement of another person's rights results in direct legal harm or costs to Everlore, you agree to cooperate with us in good faith and take responsibility for the consequences of those actions.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Everlore shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, resulting from your use or inability to use the Service, or from any unexpected AI-generated outputs.

11. Termination and Account Suspension

We reserve the right to suspend or terminate your account and access to the Service at any time, without prior notice, in the event of a breach of these Terms, suspected fraudulent activity, or to protect the safety of our platform and community.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with French law.

In the event of a dispute, the parties agree to first seek an amicable, good-faith resolution or mediation. Failing an amicable arrangement, any legal action or proceeding arising under these Terms shall be brought exclusively before the competent courts within the jurisdiction of the French courts.

13. Miscellaneous

If any provision of these Terms is found to be invalid or unenforceable by a court of law, the remaining provisions will continue in full force and effect. A failure by Everlore to enforce any right or provision of these Terms will not constitute a waiver of that right.
